The Smilies Defense


Okay.. since things are very quiet here (for the most part).. I thought I’d post something of an “Intermission” of sorts..

Now.. to those of you new comers here.. you may have noticed that I sometimes speak rather highly (or lowly) (depending on how you view these things) about a certain identity-morphing personage I've reverently dubbed his Lordship.. but just who is this Lordship person? you must be wondering.. well, he happens to be a barrister.. yes, a barrister in merry old brit land.. thus all those [not-so-subtle] allusions to all the wigs 'n robes 'n other unmentionables n’ such (a sub-subject I promised never to get into [as it were] again)..

ANYWAY.. I thought in order to introduce you to the keen legal mind of this Lordship personage, I'd re-post for you one of his most famous cases: The Smilies Defense, which was first posted on George.Wright's "Turn your cow eyes away".. some time in October of 2008.. Oh.. also.. this might explain (fairly thoroughly, in fact) something of my aversion to using smilies, as I happen to be the defendant in this case.. Oh, I might note.. the none-stop cryer of a smiler seems to be dry of tears these days.. Jarkko must be cutting back, it seems, and so the tears had to go.. (and just when we needed them most, I might add)..


.. so here goes The Smilies Defense:

[Violet]: You know, the more I stare at those stupid little smilies (the ones you see over to the right when you're writing a new post) the more I understand the nature of murder itself.. actually, that's something I should probably talk to his Lordship about... I mean, it might make for a powerful legal strategy: The Smilies Defense.. I can see it now..

[His Lordship at Court]: She was sucked into the insipid orbit of those blasted smilies, your honor. That is the basis of this defense. I mean, if you would consider for a moment, your honor, the static, insipid smiler, for example :D -- just rest your eyes on that mindless crouton for a minute and see how you fare. Or add squinty eyes, your honor, and some incessant jerking of the mouth muscles :lol: -- or better yet, add some blood curdling crimson to that big, fat, opened-mouth of a smiler :razz: , you can't imagine what that does to one's blood pressure -- why someone who'd never had a violent impulse in her life is surely to go off on that one.. and what of that bratty little "mom, I'm going to hold my breath 'til I expire" red-infused, not-even-smiling smiler :oops: -- or the never stop crying smiler, with those inordinately large cry-on-cue mechanically engineered tears :cry: (just what are they trying to say with that one, anyway??).. or the feigned innocent, rolling-your-big-black-bug-eyes-around-the-room smiler :roll: (I'd nearly choked someone myself after being sucked into staring at that one for a few magnetic moments).. or the fragment-of-a-smile, feel sorry for this crippled sampling of humanity smiler ;-) (I nearly crushed a prosecutor, if you recall, your honor, after taking a good long gander at that one).. So you see, your honor, there's just no telling what this mad house of a smilies menagerie, if I may call it that -- well, what it could incite given the right, forced-to-stay-at-one's-desk-all-weekend-then-go-out-on-the-street-for-a-moment-to- buy-some-toilet-paper-[make that a loo roll]-as-it-happens-and-get-into-a-slight-fender-bender sort of circumstance in which murderous violence is surely the only reasonable next step --

.. anyway, since these insipid smilers don't seem to be going anywhere, it's good to know a good defense attorney, methinks.. (just in case)..

working, can't play. I just pray no-one thinks the speech you presented was actually from His Lordship. He has never used a smiley and never will.

- I think it depends entirely upon how they are used...(note over-use above)
I find them useful really, because I am a right sarcastic little wotsit at times, amongst other things and clarity is needed to avoid confusion, emoticons service this requirement... to an extent.

Clare, I am a massive fan of yours but the use of smilies is indefensible. they are pictorial proof that the writer has given up, they are drawings of defeat. find the bloody words and use them, kill all smilies NOW.

.. Alsiony.. my take is that, while I do see the beneficial, even clever use of them (at times), I still think there's a good dissertation subject here just waiting to be mined.. something like: "The Rampant Passive Aggressive Use of Insipid Smilers and Its Effect on Unsuspecting Posters (Who Probably Have More Important Things They Should Be Doing Anyway, But, That's Not Really The Point)"..

.. (that I believe is very indebted to Marisha's long, computer-generated subject-thingy's).. anyway.. anyone who would like to use that as a subject of study, be my guest.. (only please keep us posted.. it could be berry interestink)..

.. oh.. I think I need to add here.. I feel, well, a certain silliness-after-the-storm sort of syndrome.. (I guess that's my feeble attempt at a disclaimer, of sorts)..

... I was winking in that post earlier - so me being serious but with a smile on my face too, I don't get 'proper cross' very often!
I shall not take up the challenge to write about smilies though! haha

.. somehow I feel the need to clarify something here.. Now, as Harry suggested, there may be no defense FOR smilies.. (well, I might temper that verdict just a bit).. but.. as The Smilies Defense I think aptly demonstrates, there's a rife store of defensible acts having to do with smilies.. I mean.. given we are all exposed to them at such forums as these, whether we approve of them or not.. they are always right there >>

.. how are you??.. you seemed to have abandoned "The Cause".. (not that I could delineate exactly what that cause is at this point).. (I think it has something to do with having Marisha spank Harry.. in a public setting.. where bananas, perhaps, are freely thrown).. You know I just realized what this place needs: a stockade.

.. okay.. well.. if we can find kwills again, I guess we could reconvene on things.. and who would think to look here??.. sequestered with the rest of the jury to determine the fate of -- oh, I forgot, I'm the defendant in this case (!).. hmm.. Alright, while we await my fate.. (notice how one needs to be very flexible with one's plot points when you develop the story line this way).. (oh, and there's no turning back, it seems).. (well.. without a lot of "tell tale" edits)..

.. okay.. gotta' run, actually.. but I do hope you're rested, Clo, and ready to take further action.. (baby bond was supposed to dig up some more dirt on Henning, I think.. but so far that highly coded Billy Ocean material he's been busy analyzing seems to have tripped him up)..

Can I just say that if emoticons are going to loose their case... then it should only be after the dreaded 'text-speak' and LOL LOL LOL has been obliterated off the face of the planet? I am not even going to bother explaining what is so wrong about these two abominations...
Seeing as it blatantly obvious that smilies are MUCH less offensive, they surely cannot be made to face judgement first?
Or is there no justice in this land?

.. me no use "text speak" (just this kind of primitive "native" talk, as it were.. as the mood strikes, that is).. and so I understand perfectly your concerns with that, A.. actually, you can't imagine how long it took me to figure out what LOL was supposed to mean.. I'm so glad I finally did though.. of course, I can't imagine people needing it as much as they seem to.. I mean.. Lording Over Laundry.. it's a bit obscure, isn't it?.. (I'm sorry my Lordship, I know I said I'd never bring that up again.. it happened accidentally, though.. in this instance.. it was something of an acronymic imperative, if you see my point.. and so really [unlike what I'd like to do with you and your lorded over laundry].. it's really out of my hands]..
